ACT 686 - INTERNATIONAL TRADE IN ENDANGERED SPECIES OF 2008: IMPLEMENTATION AND REGISTRATION REQUIREMENT

The International Trade in Endangered Species Act 2008 [Act 686] (INTESA) was approved by the Parliament of Malaysia and was gazetted on 14 February 2008. Consequently, a regulation on Permit, Certificate, Registration and Fees was gazetted on 28 December 2009. Hence, the implementation of Act 686 became effective in Malaysia beginning July 1, 2010.

Enforcement of International Trade in Endangered Species Act 2008 [Act 686] INTESA

International Trade in Endangered Species Act 2008 together with two Regulations under it namely the Regulations on Permits, Certificates, Registration and Fees and the Regulations on Rescue Centers were gazetted and come into effect on 28 December 2009.

The enforcement of INTESA enables comprehensive control of species listed under Appendices I, II and III of the CITES Convention (scheduled species). These scheduled species are contained in the Third Schedule of INTESA.

GUIDELINES FOR APPLICATION OF CITES EXPORT / IMPORT / RE-EXPORT PERMITS

 

INTRODUCTION

 

• The Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES) is an international agreement aimed at ensuring the regulation of trade in specimens of endangered wild animals and plants. Malaysia became a Party to CITES on 18 January 1978.

• The Malaysian Timber Industry Board (MTIB) serves as the Management Authority (M.A.) for timber species, while the Ministry of Natural Resources and Environmental Sustainability (NRES) acts as the Lead Management Authority (L.M.A.), responsible for all trade involving Ramin timber and Karas/Agarwood in Malaysia.

• The enforcement of trade in these species is subject to CITES as well as the International Trade in Endangered Species Act 2008 (Act 686), which came into force on 28 December 2009. Trade in these species is permitted only through the issuance of valid CITES permits.

• The export of CITES-listed products of Ramin timber (Gonystylus spp.) and Agarwood/Karas (Aquilaria spp.) from wild sources [wild (W)] is subject to established export quotas. For the export of Ramin timber (Gonystylus spp.), applications for CITES export permits may be submitted directly. However, for Agarwood/Karas (Aquilaria spp.) products, exports are subject to quota approval granted to companies. Companies must first apply for an export quota for Agarwood/Karas products before applying for a CITES permit. Quota applications must be submitted in writing to MTIB, and approval is subject to a stock inspection report of the products held by the company.

PROCEDURE FOR APPLICATION OF CITES PERMITS

 

• Effective 1 January 2026, all applications for CITES Export, Import, and Re-export permits must be submitted online through the MyCITES system (https://www.mycites.gov.my/).

• Companies must be registered as Exporters (TE) and/or Importers (TI) according to the relevant trade activities before submitting any CITES permit application. Further information on registration is available at: https://www.mtib.gov.my/perkhidmatan/pendaftaran/panduan.html

• Companies are required to comply with all applicable rules and conditions and to prepare the necessary application documents as listed below by uploading them during the application process through the MyCITES system: -

CITES Export Permit

• Invoice;
• Packing List;
• Removal Pass from the State Forestry Department (original copy);
• Registration as a Karas/Agarwood Planter (*applicable only if the source is from plantation (A), where applicable);
• Approval and Export Quota Card for Karas/Agarwood Products (*applicable only for export of Karas/Agarwood products from Wild sources (W), where applicable);
• Other documents, if required (*where applicable)

 

CITES Import Permit

• Invoice;
• Packing List;
• CITES Export Permit and/or CITES Re-export Certificate from the exporting country;
• Other documents, if required (*where applicable)

 

CITES Re-export Certificate

• Invoice;
• Packing List;
• CITES Import Permit from MTIB (original copy);
• CITES Export Permit and/or CITES Re-export Certificate from the exporting country;
• Other documents, if required (*where applicable)

• A fee of RM50.00 for the issuance of a CITES Permit must be paid within 14 days after the application is approved. All payments made are final, and no refunds will be entertained.
